The City of Cartagena has argued against the injunction requested by the management company Auditorium The Batel, before the municipal decision to stop payment of the annual subsidy due to open by the Court of Auditors .The concessionaire dossier auditorium El Batel filed an administrative appeal, last December, against the decision of the City of stop payment of 562,373.87 euros, according to the company, he would be entitled for the subsidy for the period from November 16, 2013 and May 15, 2014.
On appeal the judge asked the company to pay the outstanding certification as a precautionary measure, to which the City Council opposes its claims.
The City of Cartagena decided to halt payments to the company following the open by the Court to consider that the committed in the contract award to ensure the economic balance of the company, municipal contribution is a subsidy and therefore file, justification for spending is subject to the Law of subsidies.
This record has led the council to terminate the outstanding payments and require the company to accredit their management costs based on the terms contained in the Act grants.
On the other hand, the various municipal services have referred to the Court of Auditors all supporting documentation of the annual subsidy granted to the company based on the provisions of Statement of award of the management contract.
