The Central Administrative Tribunal of Contractual Resources of the Ministry of Finance and Public Administration has communicated to the City of Cartagena two resolutions of last April 21 in which it partially estimates the resources raised by the Spanish Association of Parks and Gardens (ASEJA) and the councilman Francisco Espejo, in front of the announcement and the specifications of the contract of conservation and improvement of gardens and trees in Cartagena.
The ruling is in favor of the appellants' claims exclusively as regards the need to extend the period for bidding, given the amount of the contract.
In this way, the court orders retroactive action at the time of drafting the specifications so that it contemplates the extension of the deadline for submission of proposals to 40 days and its publication in the Official Journal of the European Union.
The municipal government has announced that it will proceed as soon as possible to resume the hiring process in this way, after lifting the court suspending the hiring procedure.
However, the court has rejected in both decisions the other issues raised by the appellants, such as the lack of guarantees of workers' rights in the contract documents.
