ANSE: "A new General Plan for Cartagena and the nature of the municipality" (20/06/2016)

The Supreme Court ruling upholding the decision of the High Court of Justice of Murcia annulling the Municipal General Plan of Cartagena discredits those responsible for planning the coastal City Council and its mayor, and provide a new opportunity for a development model more respectful of the environment and people.

The Supreme Court held that the invalidity reaches the subsequent Order of the Ministry of Public Works and Planning of the Autonomous Community of Murcia, of 17 July 2012 on the acknowledgment of the revised text of the revision of the PGOU considering that it can not survive if the rule that served as a foundation and which is attached inescindiblemente vanishes.

The mayor of Cartagena refused to accept successive requests ANSE to restart the General Plan, and went on to describe them as "whim", naming as Director General of Planning who was head of the failed General Plan for several previous governments, despite the enormous shortcomings of it.

The Southeastern Association of Naturalists (ANSE) had requested in writing and in an interview with the mayor of Cartagena that the City would not appeal the judgment of the Superior Court of Justice (TSJ), but to develop a new plan with a new public exposure.

The organization recalls that the Supreme Court quashed the final approval of the development plan of December 2011, "serious deficiencies background document ordering land use in the municipality of Cartagena" and forced to "thoroughly review" the documents.

The plan annulled by the Supreme Court, "lowered soil protection on the southern shore of the Mar Menor consolidating the urban development of Novo Carthago, included urban land in Cala Reona and forest Atamaría, failed to provide basic cartographic information on natural habitats, environmental risks and various infrastructure, and it did not include protected soil outside which was required by European and regional legislation ".

"All these and many other shortcomings were negatively reported by the same Directorate General for Environment of the Autonomous Community" and had been exposed to the allegations made by ANSE.
