The celebration of the links would mean the immediate authorization to reside in Spain of foreign nationals in an irregular situation.
Over the past three months it has been developed by the Local Brigade Aliens and Border Police of the National Police of Cartagena, an investigation in relation to the processing of fraudulent marriages before the Civil Registry of this city.
It has been developed through close collaboration with said Registry, and based on information obtained in recent months thanks to research related to marriages of convenience between EU and Spanish citizens or citizens of third countries.
Thanks to these remarkable increase in the number of cases initiated marriage was detected and where the promoters were nationalities of third countries, mainly of Moroccan origin (non-EU).
It is mean that one of the members of the organization masquerading as official of the National Police, flaunting identifying elements of such a condition, as was a plaque emblem simulated in order to gain the trust of the victims and make they accediesen the conclusion of marriages.
With the celebration of the link, nationals of countries outside the Schengen area and mainly of Moroccan nationality, automatically had access to the residence permit in Spain as relatives of EU citizens provided for in RD 240/07.
Such permits would allow them to obtain permanent residence card renewable every five years validity.
Thus eluding fraudulently obtaining residency in Spain under the General Regime regulated by Law 4/2000, and which requires more extensive requirements.
Such residence permits contracting parties attribute to false all the rights enjoyed by EU citizens in Spain, very similar to those of these nationals.
Foreign citizens paid amounts between 3,000 and 6,000 euros to the organizers, going part of this amount intended to EU citizens who agreed to marry and then simulate it.
The parties were, for foreign nationals side after several years in Spain had failed to regularize their status by the procedures under the Aliens Act (social roots, work, renovations ...) and other Spanish or community that, in the spirit of profit succulent accepted the offer despite not having come to keep any relationship with the other party.
Once entered into the fraudulent links, foreign citizens would go to the Aliens Office to immediately get the community residence that enables them both to live and to work in Spain.
The facts have been brought to the attention of both the Civil Registry and the Prosecutor in order to proceed to the timely withdrawal of the inchoate marriages, as well as the Aliens Office for the termination of the relevant residence permits.
They have arrested three persons of Moroccan nationality and one Spanish.
By the Brigade Aliens Cartagena investigations continue, not ruling out that new arrests are made in the coming weeks.
