The Chamber of the Superior Administrative Court of Murcia resolved estimate the appeal filed by the City of Cartagena by what is considered lawful the agreement of the Board of Local Government of April 27, 2012 which provided the following points regarding the restoration of the Monastery of San Ginés de la Jara:
1) To require the Hansa Urbana SA Company so that, within a maximum period of 10 days, adopt constructive and safety measures to prevent degradation of the monument.
2) urge the company to the maximum period of one month started the restoration of the monument, following the project and the license granted in 2007.
3) Failure to comply with the requirement or paralyzed or slowed the restoration, the City Council would act under subsidiary Hansa Urbana.
The Administrative Court of Cartagena, in a ruling dated 25 May 2015, estimated that the Governing Board had no jurisdiction to decide such an agreement, accepting the position of Hansa Urbana which held that it was not obliged to undertake the works while there were no development project.
However, the judgment of the Superior Court of Justice of Murcia, on February 19, 2016, declares the validity of the agreement of the Board of Local Government of April 27, 2012.
The decision of the Board of Governors of 27 April 2012 was motivated by pressure from groups and associations in defense of heritage and by political opposition groups.
Of the three points mentioned only Hansa Urbana faced conservation works and maintenance without the City Council to execute the following sections.
In line with the commitment shown by the municipal government in the defense and protection of the historical heritage of the municipality, the mayor, Jose Lopez, has issued a letter this morning to Hansa Urbana requiring that company to rush, immediately, the restoration of the Monastery of San Ginés de la Jara.
It is recalled that the agreement of the Board of Local Government of April 27, 2012 authorizes the City of Cartagena to require the company to proceed with the restoration of the monastery.
Otherwise, local government can take care of the restoration project alternative acting under the guarantees of Hansa Urbana in its possession, the amount of which amounts to 15,003,050.52 euros.
The municipal government expresses its satisfaction with the judgment of the Superior Court of Justice of Murcia to be considered as a priority action for the recovery Cartagena, the region and the region, the Monastery of San Ginés de la Jara, symbol of Cartagena heritage that has been left to fend for too many years.
