In the appeals presented, it is stated that the City Council of Cartagena refuses to demand that the commercial company Hansa Urbana comply with a final judicial ruling of the Superior Court of Justice of Murcia that breaks the commitment to restore the BIC Monastery of San Gin s de la Jara of any urban issue.
On August 3, 2020, the Cartagena City Council was asked to immediately request the commercial Hansa Urbana to fully restore the Monastery of San Gin s de la Jara based on ruling 141/2016 urging the execution n of the same before the courts if the company refuses to carry out the restoration works or execute them subsidiarily in compliance with the final judgment of the Superior Court of Justice since the administration cannot go against its own acts , prevent or delay compliance with the final Judicial Judgments.
Therefore, the Virgen de la Caridad Citizen Platform requested the Ombudsman to intervene, requiring the Cartagena City Council to provide a firm and motivated resolution on this matter, given that the presumed silence violates the provisions of article 21.1 of the administrative procedure law.
