The proceedings began after the complaint filed by a citizen, in which he referred to having been approached by two individuals who, after intimidating him with a knife, stole his mobile phone. The Civil Guard then began the investigation to identify, locate and detain the suspects, to prevent them from committing more violent assaults against other residents of the town of El Algar. The inquiries carried out by the investigators made it possible to find out that, after the complaint, the mobile phone was being used by its owner. After obtaining the necessary evidence, the Civil Guard has investigated this person as the alleged perpetrator of the crimes of simulation of crime and fraud. According to the investigation, the purpose of the complaint was to obtain financial compensation from the insurance company. The person investigated and the proceedings carried out have been made available to the Investigating Court number 4 of Cartagena (Murcia). The Penal Code establishes that anyone who, before any judicial or administrative official who has the duty to investigate, pretends to be responsible or the victim of a criminal offense or denounces a non-existent one, causing procedural actions, will be punished with a fine from six to twelve months.
