The councilors of MC, Jesús Giménez Gallo and Isabel García, opposed this way of acting and, due to the Government's refusal to follow the legal procedures, they appealed to the courts for violation of their fundamental rights.
The sentence was notified yesterday by the Administrative Litigation Court No. 1 in Cartagena and confirms that the local Executive, in the person of Esperanza Nieto (PP), and his colleagues from the PP, Cs and transfugees, violated the Fundamental rights Giménez and García in the Informative Commission of the Treasury by forcing a vote to raise taxes without a file on this matter, despite the fact that the councilors of MC, as well as Pilar Marcos (Podemos), demanded that they not vote in those terms.
Subsequently, the Government did not withdraw the matter from the agenda of the Municipal Plenary, despite warning the Cartagena formation of what happened in the Commission.
The deputy spokesman for the Municipal Group MC, and one of the plaintiffs, Jesús Giménez, has celebrated the Judgment, noting that "once again, Justice again condemns this despotic and incapable Government whose way of doing politics is unforgivable, as it affirms the Judgment itself. "
Giménez added that "the magistrate started the record of the tax increase of more than 2 million euros that entered into force on January 1 and that Arroyo, Padín and Castejón will now have to cancel."
