The mayor, Ana Belén Castejón, announced on Tuesday the order of the Court of Instruction number 1 of Cartagena that includes the provisional dismissal of the case opened by administrative prevarication against the first mayor, as a result of the decision adopted by the team of Government to paralyze the concession of the license for the demolition of the prison of San Antón when understanding that it could suppose an irreversible damage to the patrimony of the city.
As Castejón explained to the media, 'the judge concludes that the decision adopted in any way can be considered constitutive of a crime of prevarication insofar as it does not constitute an unjust resolution, nor far from social interests, and this because, after several vicissitudes of the procedure and despite the fact that initially the Directorate of Cultural Property denied the extension of the protection requested by the City Council, the Administrative Litigation Chamber of the TSJ by car dated May 3, 2019 gave the City Council the reason.
In addition, the mayor stressed, 'in his car the judge adds that the granting of the demolition license would have caused irreparable damage that the different parties involved in the administrative procedure try to avoid.'
In this way, the conclusion is that it cannot be considered that there are indications that the mayor has incurred, by action or omission, in a conduct that could be considered a crime, for which and despite not yet being firm the resolution, Ana Belén Castejón has been satisfied to match the decision of the court with that of the government team he directs.
