The administrative litigation room of the Superior Court of Justice (TSJ) of the Autonomous Community of the Region of Murcia has once again proved right to the City of Cartagena and has again agreed to the precautionary suspension of the demolition of the prison pavilion of the former prison of San Antón, until the dispute maintained by the session with the regional administration on the scope of the declaration of the facilities of the old prison as a Property of Cultural Interest, as reported by the mayor, Ana Belén Castejón, is resolved.
The resolution, issued on September 3, maintains the criteria of the TSJ itself manifested in a previous order dated May 3 in which it acceded to the precautionary suspension of the demolitions, requested by the City Council, on the occasion of the lawsuit filed against the Community Autonomous on the scope of the elements to be protected from prison as a result of its declaration as BIC.
The car that now corroborates that suspension has its origin in the dissensions of the General Directorate of Cultural Property to suspend the license to demolish the elements that should not be protected according to their criteria, such as the prison pavilion and a part of the perimeter wall .
Among the legal bases that have been taken into account by the court is the fact that these demolitions cannot be repaired, if the final judgment considers that the flag should be included in the BIC statement.
The City Council of Cartagena maintains a dispute with the Autonomous Community for the change of criteria that it adopted regarding the scope of the protection of the San Antón Prison, since in a first BIC file that expired, the General Directorate of Cultural Property had advocated for the conservation of all its elements.
Subsequently, when a new file was initiated, it limited the protection to the perimeter walls and leaving out its interior rooms such as the prison modules and the inmates' rooms, something inherent to the history of any penitentiary center.
