The new municipal tax ordinance of Cartagena comes into force (02/07/2019)

Yesterday, Monday, July 1, came into force the new Regulation Ordinance of the Urban Public Transport Service of Travelers in Tourist Vehicles by Taxi in the municipality of Cartagena, after its publication on Saturday in the Official Gazette of the Region of Murcia .

The new regulation, which replaces the previous one in 2002, implies the adaptation of the service to Law 10/2014, of December 27, Regulating the Public Transport of Persons in Tourism Vehicles by means of Taxi of the Autonomous Community of the Region of Murcia.

The text is the result of a broad consensus with the sector as evidenced by the fact that there were no allegations during its public presentation, after the agreement of initial approval by the plenary last February.

SECOND ACTIVITY

One of its novelties is the conditions to hold a taxi license, which allows the possibility that taxi drivers in Cartagena can reconcile a second activity under a series of conditions.

Also the extension of its participatory nature that reaches beyond the most representative professional associations of the legally constituted sector, to the union organizations and of consumers and users with implantation in our municipal term.

SUSPENSION OF LICENSES

In relation to the provisional suspension of taxi licenses, a more extensive regulation is provided to that provided in the regional law for cases of illness or any circumstance of force majeure that prevents the provision of the service.

In this case, the licensee may request the suspension of the license for a maximum period of one year, extendable to two, and for personal reasons, the suspension of the license for the same period without reaching, the number of suspensions, 15% of the total fleet.

EMPLOYEES

Another novelty is the provision of service by salaried drivers in case of transitory incapacity of the owner.

This means that, temporarily and exceptionally, a more salaried driver may be authorized and a prohibition is explicitly established that license holders can not be hired as employees by another holder.

CARD PAYMENT AND GEOLOCALIZED

With regard to vehicles and their technical conditions, it is expressly provided that vehicles may not exceed the age of twelve years from the time of first registration.

They must also have telematics systems for payment and service billing and geolocation with the SOS system.

In this sense, the city council will promote the progressive implementation of technological innovations, navigation systems, the reduction of noise emissions, the promotion of low pollution vehicles, the optimization of the recycling of the materials used and any other innovation introduced in the sector.

EUROTAXIS

It also establishes as novelty related to eurotaxis or adapted taxis, where the municipality will have to comply with the minimum percentage of adapted vehicles established by the specific sectoral legislation.

WORKDAY

As regards the performance of the activity and the ordering of the service, it is established that the stops, the calendar, the working day and shift schedule will be approved by the Governing Board agreement, for greater efficiency and agility in the face of possible modifications in the matter.

HYGIENE AND CLOTHING

Likewise, it is specially regulated that the driver will present a hygienic, sanitary and appropriate clothing aspect during the provision of the service.

In case of failure or disablement of the taxi, the temporary replacement of the vehicle by another one is expected, which meets the same requirements as the replaced one and for a period not exceeding two months.

TOURIST TAXES

Another important novelty makes reference to the so-called tourist taxi with urban itineraries of tourist-monumental-landscape significance, agreed by the Government Board at the proposal of the Department of Tourism.

The city council will promote the publicity of this service, identify these vehicles through a municipally approved badge and will have audio-guides that explain the historical-artistic content of the itinerary in Spanish and English, with the rest of the languages ​​being optional.

SANCTIONS

Finally, the regime of infractions and sanctions provided for in Law 10/2014 is regulated with penalties ranging from 100 to 4,001 euros, without prejudice to the possibility of revocation of the license in favor of the city council.
